Actually, it can, they'd need to make absolutely ZERO references to Pam or the "the boy who drowned" part of the first film but it COULD happen. Just with quite a lot of jumping through legal loops. :/

What lawsuit they are getting rights to every killer, that is why they are having people guess who the new killer is because they got the rights to put him in a game. @CheersTC

They've never had to face a lawsuit however, the closest they've ever been is Freddy, in which they decided they'd go with the 2010 remake.
