In fact we're not getting any exclusive content. On top of that the content we get is miserable. I would rather see massive amounts of bp/iri or like 500 auric cells instead so I can buy a character/perks with it.

There's still nothing anyone could do because they never said every cosmetic was exclusive it could fall into the "other special offers" category and that's all they would have to say there would be no lawsuit unless they claimed that everything was exclusive which they never did, the lawsuit would never see daylight

like. Yeah I also think it’s a bad choice. And I would still consider it bad even if it was a recolor. But why do so many people get so unreasonable with their complaints?

I'm not sure what kind of damages you could even sue for, because nowhere have they specified:
- How many items you receive per month, or
- The average value of the items you receive in a month, or
- That the items offered to you must fall into one of those advertised categories.
Any judge would dismiss such a lawsuit on its face as there's no way you could reasonably claim damages when offered a free in-game cosmetic that you already own.
In fact, the title of this post could be viewed as defamatory as it accuses Amazon/BHVR of a crime. OP, even if you are memeing here, what you're doing is legally risky.

As a reminder, the cosmetic is not "free". It is part of a package that is paid for. The actual value may only be a penny, but it still a value. That said, this wouldn't make it to actual trial due to the fact that they have themselves covered with the vagueness of the wording.

You don't even have to go EULA/TOS diving to realize that's not the case, it says right there in your screenshot "... and other special offers". That's not referring to something with a particular "specialness level", that's an extremely general term that can basically mean anything under the sun.

It's a fairly meaningless semantic difference, to be honest. It's not "free" in that you have to pay for Prime to get the offer, but it is "free" in the sense that if Prime had exactly the same offers this month except this one skin, they wouldn't be in material breach of any contract as there's absolutely no written guarantee how many offers you get each month.
Basically, the offers are not technically fungible, but they effectively are (in this context, anyway).
