just had this happen to me with a nemesis who clearly knew about it since he just kept saying "ez" in endgame chat i think it's when it's equipped with undying since he had it as well

Can confirm, same issue here edit: Apparently it still counts the stacks, but doesn't show the perk as activated until you have all 3.
