Did you disconnect from the match? You cannot spectate if you disconnect, this is intentional.

Nope it was new "give up" option, we were all slugged and I wanted to spectate my teammates but I couldn't

You are still technically disconnecting from the match, just without incurring the associated penalty. It would seem that the game has not (yet) made the distinction between actually quitting and using the surrender feature.
