Just ran into someone who was able to bring the tier 1 version of this perk, even though it's SUPPOSE to be killswitched.

It is kill switched. The problem is you need to restart your game for the kill switch to take effect. So in theory if you kept your game open for days you can bypass the kill switch. Also not sure if the random challenge ignores kill switch or not.

I figured maybe it had something to do with the lvl of the perk. Every perk for the entire team was lol 3, except that one.
