This achievement is fine. BHVR's QA team managed to get it so it cannot be broken. It's not like they would let such blatant mistakes make it into a release.1 -

Instead of asking for ways to prevent being downed, such as stealthier animations, better rewards for stealth play, more actual chase breakers not chase extenders etc.1
